These Terms and Conditions (“Terms”) govern your use of the services provided by Ikonn Media Group (“we,” “us,” or “our”), including lead generation, demand generation, email marketing, and data supply services. By engaging with our services, you (“Client”) agree to comply with these Terms. Please read them carefully before proceeding.

1.Services Overview

Ikonn Media Group, located at 145 City Road, London EC1V 1AZ, provides B2B lead generation, demand generation, email marketing, and data supply services across various sectors, including IT, Finance, Automotive, and more. We specialize in data profiling, audience selection, and facilitating soft contact between clients and prospects.

2.Engagement and Acceptance of Services

By engaging with Ikonn Media Group, the Client acknowledges and agrees that:

  • Services will be delivered according to the specifications outlined in the relevant service agreement or statement of work (“Agreement”).
  • The Client is responsible for providing accurate and complete information necessary for service delivery, including target audience profiles and any specific requirements.
  • Any changes to the scope of services must be mutually agreed upon in writing and may affect delivery timelines and costs.

3.Lead and Data Supply

  • All leads and data supplied by Ikonn Media Group are sourced in compliance with applicable data protection regulations, including the General Data Protection Regulation (GDPR) for EU data subjects.
  • The accuracy of the data supplied will be verified through our validation processes, but Ikonn Media Group cannot guarantee the continued accuracy of the data beyond the point of delivery.
  • The Client acknowledges that all data supplied is for the Client’s exclusive use, and any unauthorized sharing or resale of data is strictly prohibited.

4.Email Marketing

  • Email marketing campaigns conducted by Ikonn Media Group are subject to the Client’s approval before distribution. The Client is responsible for ensuring that their email content is compliant with applicable laws, including anti-spam legislation (e.g., CAN-SPAM Act, GDPR).
  • Ikonn Media Group takes no responsibility for any legal consequences arising from the content or nature of the email campaigns provided by the Client.

5.Fees and Payment Terms

  • Fees for services will be outlined in the Agreement between the Client and Ikonn Media Group. Unless otherwise specified, all invoices are payable within 30 days of receipt.
  • Late payments may incur additional charges, and Ikonn Media Group reserves the right to suspend services until full payment is received.
  • All fees are exclusive of VAT unless otherwise stated.

6.Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or sensitive information exchanged in the course of service delivery. This obligation will remain in effect even after the termination of the Agreement.

7.Intellectual Property

All intellectual property, including methodologies, data, reports, and marketing materials generated by Ikonn Media Group during the engagement, remain the property of Ikonn Media Group unless otherwise stated in writing.

8.Liability

  • Ikonn Media Group will make every reasonable effort to ensure the quality and accuracy of the services provided. However, we will not be liable for any indirect, incidental, or consequential damages resulting from the use of our services.
  • Our total liability in any matter related to these Terms will be limited to the amount paid by the Client for the specific service in question.

9.Termination of Services

  • Either party may terminate the Agreement with 30 days’ notice in writing.
  • Ikonn Media Group reserves the right to terminate services immediately in the event of non-payment, breach of terms, or unethical use of the services provided.

10.Data Protection

  • Ikonn Media Group complies with the GDPR and other relevant data protection laws. By engaging our services, the Client warrants that any data provided to us is compliant with applicable data protection legislation.
  • Ikonn Media Group processes personal data strictly for the purposes of service delivery and in accordance with our Privacy Policy.

11.Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
